TRAVIS DAXON RICHARD

Dax Richard concentrates his practice in the areas of commercial and professional liability litigation, and employment related disputes. He has experience litigating in federal and state courts and in numerous arbitrations before the national Association of Securities Dealers and American Arbitration Association. Additionally, Dax has participated in related appeals to the Court of Appeals - Fifth District of Texas at Dallas and the Texas Supreme Court.


Representative Experience

  • Obtained a defense verdict in Jasper County on behalf of a construction company in a lawsuit involving allegations of trespassing and conversion. Jury found the co-defendant — an adjacent land owner — to be solely responsible for the damages alleged.
  • Successfully defended a client pest control company in an arbitration proceeding where claimants sought in excess of $1.88 million for alleged breach of contract. The arbitration award vindicated the client and ordered that the claimants take nothing on their claims. Additionally, the arbitrator awarded $78,000 to the client for counter-claims brought in the arbitration.
  • Successfully defended client in an arbitration proceeding filed against a specialty car manufacturer by its former marketing company. While representing the manufacturer, assisted in the development and presentation of evidence used to contradict the marketing company’s factual allegations and claims for damages. The arbitrator ultimately awarded less than 5% of the damages claimed in the marketing company’s Complaint in Arbitration.
  • Obtained summary judgment against plaintiffs who were seeking a declaratory judgment for the imposition of an access easement over land owned by a client land developer. In conjunction with the ruling, obtained a judgment awarding a portion of the client’s attorneys fees to be paid to the client by the Plaintiffs.
  • Successfully defended a police officer in the administrative appeal of his termination which resulted in his full reinstatement.
  • In a case involving a large sports complex suing clients over an alleged breach of a luxury suite lease agreement, obtained summary judgment against plaintiff on behalf of clients who were not parties to the agreement.
  • Obtained a favorable settlement which ultimately recouped all monies lent on behalf of a client bank that had been induced into lending money based on forged loan documents.
