BRIAN A. SHEGUIT
Brian's primary practice area is commercial litigation. In this practice area,
Brian represents businesses, insurance companies, and individuals. He
handles a wide range of commercial matters including business dissolutions,
partnership disputes, oil and gas disputes, construction claims, and finance
claims. Brian also assists clients with a variety of other matters including
professional negligence claims, product liability matters, premises liability
claims, landlord-tenant disputes, and bankruptcy.
Representative Experience
- Obtained summary judgment for a component part manufacturer of a Class III medical device, a cochlear implant, in a case alleging negligence and product liability.
- Obtained summary judgment for a corporate defendant in a wrongful foreclosure lawsuit. The judgment provided for recovery of the foreclosed property as well as damages on a counterclaim for breach of contract.
- Assisted a plaintiff in obtaining partial summary judgment in a dispute over a promissory note. The judgment amount exceeded half a million dollars.
- Obtained summary judgment for a corporate plaintiff on a breach of contract claim. The judgment provided for the recovery of actual damages in excess of one hundred thousand dollars as opposed to the minimal liquidated damages set out in the contract.
- Obtained multiple judgments in landlord-tenant disputes resulting in recovery of leased property as well as damages for breach of lease.
- Assisted a corporate defendant in obtaining dismissal of a lawsuit seeking cancellation of a home equity loan and return of funds.
