Greg Ziegler and Dax Richard Win Summary Judgment in Multi-Plaintiff Employment Discrimination Case
Three nursing home staff members whose employment was terminated for violation of anti-abuse policy sued their former employer in federal court for race discrimination, defamation and intentional infliction of emotional distress. The nursing home presented undisputed evidence of a legitimate, non-discriminatory purpose for discharging the Plaintiffs. The Plaintiffs alleged the reasons stated for termination were pre-text. The federal district court for the Eastern District Beaumont Division granted summary judgment for the nursing home that Plaintiffs take nothing on all claims. The Court found that the alleged defamatory statements were believed to be true at the time and that the statements were protected under qualified immunity. The Court rejected the claims for intentional infliction of emotional distress as they were not separate and distinct from the alleged discrimination claims. Greg Ziegler and Dax Richard defended the nursing home chain.
