Clayton Devin Secures Defense Verdict in Breach of Warranties and Deceptive Trade Practices Suit

On October 19, 2007, a Tarrant County, Texas jury found in favor of a national manufacturer and retailer of paint and industrial coatings in a case filed by the owner of a large Fort Worth apartment property. The lawsuit arose out of a failed painting project involving the exteriors of 42 buildings. The plaintiff alleged breach of express and implied warranties and violations of the Texas Deceptive Trade Practices Act. The defense argued that the cedar siding of the buildings had delaminated as a result of poor long-term maintenance and age, and that the paint products performed as represented.
