Clayton Devin and Noreen Grant Obtain Defense Jury Verdict for Apartment Complex

On May 17, 2005 a jury in the 298th District Court of Dallas County, Texas found in favor of the owner of a Dallas apartment complex in a premise liability action brought by a former tenant.

The plaintiff alleged that she was accosted by a guest of another tenant in a laundry room, forced into a nearby apartment and raped. The claimant asserted that the apartment complex was located in a high crime area, and that management failed to use reasonable care to deal with a foreseeable risk of violent crime on the premises.

The apartment complex's owner was represented by Clayton Devin and Noreen Grant of Macdonald Devin, P.C. The defense attorneys highlighted conflicting evidence regarding the circumstances of the alleged assault and effectively offered proof of the apartment management's efforts to prevent crimes on the premises.
