Jennifer has over fifteen years of experience representing businesses and professionals in complex litigation and serves as outside general counsel for small and midsize businesses facing every kind of business dispute. A veteran defender of multimillion-dollar claims, Jennifer’s diverse practice includes construction defect, employment law, environmental law, general business law, contract drafting and negotiation, premises liability, product liability, professional liability, and toxic torts.

Her construction law practice includes the representation of developers, architects, general contractors, subcontractors, and engineers in cases involving residential and commercial construction. Jennifer is also certified in Environmental Risk Management and has extensive experience with claims involving mold, lead, benzene, toluene, hydrogen sulfide, and ammonia.

Fitting of her holistic approach to the representation of her clients, Jennifer assists clients in transactional and contract matters, and has represented employers and employees in disputes involving alleged wrongful termination, sexual harassment, and breach of non-compete agreements.

Jennifer is a graduate of Texas Christian University where she was named Distinguished Student of the Year during her senior year. She earned both a law degree and an MBA from Baylor University, where her advocacy skills were recognized with multiple honors in moot court competitions. She is a frequent speaker and presenter on a variety of litigation and general business topics.

Active in numerous philanthropic organizations, Jennifer also enjoys traveling, spending time with her family, hiking, and volunteering.

She is admitted to practice law in all Texas state courts as well as the U.S. District Court for the Northern and Southern Districts of Texas and the U.S Court of Appeals for the Fifth Circuit.

Representative Experience

Construction Litigation

  • Obtained a jury verdict in favor of a fire sprinkler company where the plaintiff sought $450,000 in damages based on alleged violations of the applicable fire code and Texas Administrative Code in the design and installation of a fire sprinkler system.
  • Obtained a partial jury verdict in favor of a developer where the plaintiff builder sought over $5 million in damages. All questions answered by the jury were in favor of the defendants.
  • Defended an owner’s representative against a lawsuit filed by a tenant alleging damages of $34 million against multiple parties where tenants asserted claims of breach of contract and negligence. She achieved a nuisance value settlement for defense costs.
  • Within 3 months of appearing as substitute counsel in a case that had languished for over a year, obtained summary judgment based on Texas’ economic loss rule for structural engineering in a suit in which a commercial building owner asserted a negligence claim based on contractual damages

Business and Commercial Litigation

  • Defended a minority shareholder in a lawsuit filed against his employer involving allegations of breach of his employment contract and minority shareholder oppression. She negotiated settlement through mediation.
  • Pursued an embezzlement claim against a client’s employee which included obtaining a temporary restraining order and garnishing the employee’s bank accounts.
  • Defended a steel company in a breach of contract dispute and successfully negotiated a nuisance value settlement within two weeks after the plaintiff filed suit.
  • Obtained summary judgment on behalf of consultant in a lease dispute that also involved allegations of negligent misrepresentation and fraud.

Environmental Law and Litigation.

  • Obtained complete dismissal of a lawsuit involving allegations of CERCLA violations and perchloroethylene contamination on behalf of a solid waste disposal company.
  • Successfully defended a construction company against alleged violations of the SWPPP and Texas Water Code achieving a nuisance value settlement of 1% of alleged damages.
  • Defended an oil company against allegations by seven plaintiffs claiming exposure to hydrogen sulfide and $4 million in damages.

Contract Negotiation and Drafting

  • Represented a supplier of a recycled fuel oil in a contract dispute with a customer with over $1 million at issue, and negotiated a future supply contract while resolving underlying dispute over existing contract.
  • Drafted and negotiated a real estate purchase agreement and provided counsel regarding indemnification provisions.
  • Drafted a buy back agreement and promissory note for investors.

Employment Litigation

  • Obtained complete dismissal of claims asserted against employer client for alleged sexual harassment and discrimination.
  • Defended former employees in non-compete and breach of contract lawsuit and negotiated a settlement agreement.
  • Defended an employer against a claim of wrongful termination and achieved a nuisance value settlement.

Product Liability

  • Obtained summary judgment on behalf of paintball marker manufacturer in a case involving a teen blinded in one eye while using the product.
  • Obtained a nuisance value settlement on behalf of lead sheet manufacturer by proving that the plaintiff’s alleged lead poisoning was not caused by a defective product, but was instead caused by the employer’s failure to follow proper OSHA procedures.
  • Successfully defended automobile manufacturers and component part manufactures in personal injury lawsuits.
