Luke Davis is a well-versed civil and commercial litigator who provides skilled representation and sound counsel to a wide range of clients, from individuals to Fortune 500 companies. Luke prides himself on his accessibility to his clients as well as the thorough and consistent communication and updates he provides them about their matters.

Luke’s talents as a litigator are enhanced by his extensive teaching experience, which he uses to powerfully “tell the story” of each case in a straightforward, persuasive manner, whether to judges, jurors, or mediators. He is adept at adopting and using new technologies to more effectively organize, evaluate, and present each case.

In federal and Texas state courts, both as sole trial counsel and within a litigation team, Luke’s diverse practice has included matters involving contracts, fraud, breach of fiduciary duty, business torts, employment, real estate, construction, product liability, lender liability, landlord/tenant, leasing, deceptive trade practices, unfair competition, corporate governance, antitrust, bankruptcy, probate, class actions, insurance defense, and insurance coverage. He is actively involved with all aspects of pretrial discovery and trial preparation, and endeavors to resolve cases in a cost- effective and conclusive manner.

Luke earned his Juris Doctor with high honors from Texas Tech University, where he was awarded the Order of the Coif and served as Articles Editor for the Texas Tech Law Review. He received his undergraduate degree cum laude with University Honors from the University of North Texas.

Living in the Lake Highlands area of Dallas for more than 30 years, Luke and his wife Paula have always been active volunteers in a variety of civic and non-profit organizations, local schools, and their church.

Luke is admitted to practice in all Texas state courts as well as the United States District Court for the Northern, Southern, Eastern and Western Districts of Texas and the United States Court of Appeals for the Fifth Circuit.

Representative Experience

  • Successful products liability defense of underground storage tank manufacturer in 3-week jury trial in Northern District of Texas following multi- state discovery. Claims involved tanks installed at numerous gasoline stations.
  • Defense of antitrust claims against non-profit soccer governing bodies, including 2-week jury trial in Northern District of Texas. Obtained Fifth Circuit’s reversal of antitrust damage award against clients.
  • Successful defense of personal injury lawsuit based on alleged exposure to chemicals. Texas state trial court granted summary judgment after granting pretrial motion to strike plaintiff’s expert witnesses and reports. The Court of Appeals court affirmed the trial court judgment.
  • Successful defense of fraud, contract, DTPA, and declaratory judgment claims against product manufacturer. Texas state trial court granted no-evidence summary judgment based on absence of damage evidence following extensive discovery. The Court of Appeals affirmed the trial court judgment.
  • Trademark litigation in state and federal courts, including First Amendment and Right of Publicity issues relating to production and marketing of sports trading cards.
  • Arbitrations in construction, oil and gas, and securities disputes.
  • Broad-based civil and commercial litigation practice in state and federal courts at both the trial and appellatelevels.
  • Defense of Southwest Athletic Conference against media claims that conference was subject to the Texas Open Records Act. Prevailed on appeal to United States Court of Appeals for Fifth Circuit following trial in Western District of Texas.
  • Involved with sports law issues related to television rights of Southwest Athletic Conference, dissolution of Southwest Athletic Conference, and Firm’s work as counsel for World Cup Dallas.
  • Represented general contractor in various Texas state courts in actions relating to construction defects, subcontractor disputes, and bond claims
  • Eleven Line, Inc. v. North Texas State Soccer Ass’n, 213 F.3d 198 (5th Cir. 2000) (obtained reversal of award of lost profit damages)
  • Kneeland v. NCAA, 850 F.2d 224 (5th Cir. 1988) (obtained appellate court judgment that Southwest Athletic Conference was not subject to the Texas Open Records Act)
  • Booklab, Inc. v. Konica Minolta Business Solutions USA, Inc., 2012 Tex. App. LEXIS 7683 (Tex. App.—Dallas, Sept., 7, 2012, pet. denied) (affirmed summary judgment; no evidence of plaintiff’s alleged damages)
  • Feria v. Dynagraphics Co., 2004 Tex. App. LEXIS 2366 (Tex. App.—El Paso, March 15, 2004, pet. denied) (affirmed striking plaintiff’s medical experts and granting summary judgment)
