Peter Kerr is a talented and tested litigator who brings his strategic advocacy skills to bear on behalf of clients involved in commercial and construction litigation. He has obtained favorable results in a wide range of complex matters, including construction defect cases, trade secret misappropriation claims, employer-employee disputes, contract disputes, patent infringement litigation, and business torts.
With experience representing major corporations in federal and state courts and governmental agencies at all levels, Peter has worked on matters covering a broad range of subjects. Recent cases that have benefited from Peter’s involvement include those relating to the licensing of client technology, defense of wrongful death claims, municipal and government employee/employer litigation, and employee non-compete and non-disclosure agreements.
A veteran of Operation Iraqi Freedom who is fluent in Spanish, Peter graduated from the University of Texas at Dallas before earning his law degree from Baylor Law School.
Peter is licensed to practice in all Texas state courts as well as the U.S. District Court for the Northern, Eastern, Southern, and Western Districts of Texas. When not serving his clients, Peter enjoys volunteering, recently focusing his efforts on the formation and administration of minority-owned businesses.
Representative Experience
- Representation of general contractors in construction defects lawsuits and arbitration, including cases involving structural deficiencies and water penetration; prosecution of claims against subcontractor and supplier third-party defendants
- Representation of condominium, residential, and mixed-use property owner associations in litigation, including injunctive and equitable relief related to enforcement of restrictive covenants and claims for breach of contract, negligence, and employment-related claims
- Representation of general contractors in construction defects lawsuits and arbitration, including cases involving structural deficiencies and water penetration; prosecution of claims against subcontractor and supplier third-party defendants
- Representation of general contractor against homeowners’ claims of construction defect, breach of contract and fraud related to construction of condominium units
- Representation of subcontractor in defense of water damage claim in connection with construction of residential structure
- Successfully obtained dismissal of claims asserted by general contractor against subcontractor client in construction defect lawsuit
- Successfully mediated on behalf of general contractor in a commercial construction defect suit involving commercial property owners and all pertinent subcontractors, including drafting of settlement agreement and release
- Representation of third-party contractor in litigation and settlement negotiations regarding a multi-million-dollar condominium project
- Representation of general contractor for the purpose of providing insurance coverage opinion in a half-million-dollar dispute
- Formation of over 85 business entities for minority-owned businesses
- Representation of leading manufacturer of cast-iron pipe in employment discrimination suit, EEOC investigation, wrongful death suit, and products liability cases
- Representation of affiliate of world’s largest airlines company in FLSA collective action suit
- Successfully defended largest international manufacturer of fire-suppression systems and portable extinguishers against multiple suits involving DTPA and negligence claims
- Representation of oil and gas service company in tortious interference and unfair competition.
- Successfully obtained temporary restraining orders and temporary injunctions for convenience store owners in breach of contract suit and landowners against an oil and gas company
