Wes Davis is an experienced litigator driven by a desire to put his clients in the strongest position to obtain a successful outcome. With a focus on finding strategic and creative ways to advocate for his clients, Wes has crafted winning arguments and effective strategies at every litigation stage, including pre-trial evidentiary preservation and investigation, interlocutory appeals and writs of mandamus, and post-trial briefing and the final appellate process.

Wes joined Macdonald Devin as an associate in 2013, bringing with him well-honed legal and analytical skills as well as a record of successes in a wide range of matters at both the trial and appellate levels. He has an impressive motion practice history, obtaining summary judgments and dismissals that have either ended cases outright or positioned his clients to negotiate highly favorable settlements. His practice areas include construction law, government contracts, intellectual property, insurance coverage, and medical malpractice.

A graduate of the University of Texas at Austin, Wes earned his law degree from the George Washington University in Washington, D.C. Wes returned to his native Texas after law school, where he has been an active member of his profession and his community. He is a member of the State Bar of Texas and the Dallas Bar Association, and for years has served as a mentor to local youth as a volunteer with the Big Brothers Big Sisters of North Texas.

Wes is admitted to practice in all Texas state courts, the U.S. District Court for the Northern, Southern, and Eastern Districts of Texas, and the U.S. Court of Appeals for the Fifth Circuit.

Representative Experience

  • Only three months after appearing as substitute counsel in a case that had languished for over a year, obtained summary judgment for structural engineering firm based on Texas’ economic loss rule in a suit by a commercial building owner asserting a negligence claim based on contractual damages.
  • Obtained appellate victories from the Fifth Court of Appeals mandating dismissal of medical liability claims against nursing facilities in two separate cases in which the trial courts allowed claimants to amend otherwise deficient reports but ultimately denied the nursing facilities’ motions to dismiss.
  • Successfully moved for and obtained application of settlement credit of more than $1 million in complex design professional and construction case.  After multiple defendants settled, the court applied the full amount of all settlement agreements as credits, resulting in a favorable judgment for the client.
  • Obtained summary judgment for structural engineer in construction defect case based on Texas’ economic loss rule, eliminating the majority of the plaintiff’s damage claims.
  • Represented architect in construction dispute, successfully obtaining interlocutory reversal of trial court order denying motion to dismiss pursuant to Texas Civil Practice and Remedies Code Section 150.002 (the “Certificate of Merit” statute).
  • Obtained interlocutory reversals of two trial court orders denying motions to dismiss pursuant to the Texas Medical Liability Act. One reversal resulted in dismissal with prejudice of the plaintiff’s claims and award of attorney’s fees to the defendant.
  • Successfully obtained writ of mandamus requiring trial court to vacate reinstatement of previously-dismissed case because the trial court’s plenary power had expired at the time of the order.
  • Obtained summary judgment ruling for joint business owner in dispute over stock ownership, resulting in favorable settlement.
  • Successfully obtained summary judgment in insurance coverage dispute establishing that coverage by the defendant was triggered and establishing liability, resulting in settlement in client’s favor in excess of $10 million.
  • Successfully obtained no-fault verdict in arbitration in dispute over online auction of property, resulting in take nothing judgment.
  • Defended online auction company in dispute with losing bidder who claimed damages of $20 million resulting from its lost business opportunity.
