Bryan Rutherford and John Kenefick win appeal for fitness center and personal trainer

The plaintiff sued her personal trainer and fitness center for claims arising from a personal injury she sustained while exercising. On the eve of trial, the trial court granted summary judgment to both defendants, based on contractual indemnity and release clauses. The Dallas Court of Appeals affirmed the summary judgment, holding defendants satisfied the express negligence doctrine, which barred the plaintiff’s claims.
