A Collin County jury returned a defense verdict for Macdonald Devin’s nursing home client in a lawsuit brought by the heirs of a nursing home resident’s estate.
The lawsuit alleged that two Stage IV pressure ulcers developed due to alleged failure to properly assess, monitor, and treat the ulcer and alleged failure to timely notify the treating physician of the worsening and infection of the wound. Photographs and graphic hospital records describing the ulcers were admitted into evidence and published to the jury.
After a week of trial, the jury rejected the Plaintiffs’ claims, finding that the nursing home complied with the standard of care and returning a take-nothing verdict.
