Jennifer Edgeworth and Wes Davis win summary judgment for structural engineer

Shareholder Jennifer Edgeworth and Associate Wes Davis won summary judgment for a structural engineering firm and its individual licensed structural engineer sued by a commercial building owner which did not have a contract with the engineering defendants.

Jennifer and Wes argued that the economic loss rule and the Texas Supreme Court’s opinion in LAN/STV v. Eby required summary judgment immediately as a matter of law without factual or expert discovery.

Macdonald Devin substituted as counsel for the engineering defendants after the case had languished for over a year.  Summary judgment was obtained within 3 months of MacDonald Devin’s appearance without taking any depositions.
