John Kenefick, James Mendez and Paul Downey were successful on a motion for summary judgment in favor of a commercial property owner in Dallas, Texas in a case involving an alleged shooting on the premises.
The motion argued that plaintiff failed to establish the necessary elements of proof as required by the Texas Supreme Court in Timberwalk Apartments v. Cain.
Armed with an understanding of how Texas Appellate Courts view premises security cases, the team was able to set the motion up for success through targeted written discovery and well-planned depositions.
