Jason has handled a diverse range of matters, achieving positive results for his clients in court, in mediation and settlement negotiations, and through working directly with opposing counsel.

Overview

Jason’s practice focuses on large, complex, multi-party commercial and residential construction litigation, primarily representing general contractors. Jason also represents subcontractors and design professionals to shift liability to other trades and parties. His success in this complex area of the law has earned him the distinction of being chosen for inclusion on the Texas Rising Stars list for four years in a row. This honor, given to no more than 2.5 percent of the lawyers in the state, is reserved for attorneys 40 years or younger or in the first 10 years of their practice who have attained a high degree of peer recognition and professional achievement.

In addition to compiling an impressive record in construction litigation matters, Jason also represents oil field and saltwater injection contractors for property and personal injury damage claims, and has obtained defense verdicts in his clients’ favor on multi- million dollar claims.

A graduate of the University of Texas at Austin, Jason earned his law degree from Southern Methodist University. He is active in numerous professional organizations, including the Dallas Bar Association, the Dallas Association of Young Lawyers, the State Bar of Texas, DRI: Voice of the Defense Bar, the Texas Young Lawyers Association, and the Claims & Litigation Management Alliance. Jason is admitted to practice in all Texas state courts as well as the U.S. District Courts for the Northern, Western, and Southern Districts of Texas.

Representative Experience
  • Obtained Summary Judgment for window and door manufacturer for $1 million product liability claim relating to product defects, installation issues, and flood damages
  • Obtained Summary Judgment for financial institution against $8 million claim under the theories of negligence, breach of warranties, breach of fiduciary duty, breach of contract, fraud, misrepresentation, and Deceptive Trade Practices Act violations
  • Obtained Directed Finding order from three-arbitrator panel at the close of the Evidentiary Hearing for a subcontractor in a large multi-party construction litigation
  • Obtained a No Award of Damages ruling in a large construction arbitration
  • Obtained summary judgment and subsequent appeal for government utilities operator in a lawsuit involving flood damage related to operation and maintenance of government-owned utilities equipment
  • Obtained bench verdict and judgment for cattle owner based on conversion and unjust enrichment for cattle grazer’s improper exercise of control and dominion over livestock
  • Obtained spoliation order in subrogation lawsuit against insurance carrier for negligent destruction of evidence during possession of property.
  • Settlement for general contractor for 1.3% of alleged damages following elimination of $31 million claimed damages based on contract terms.
  • Successfully defended motions to dismiss in Dallas County based on Chapter 151’s Certificate of Merit requirements; affirmed by the Fifth Court of Appeals and Texas Supreme Court.
  • Prevented construction defect lawsuit based on chain of title for release of claims and terms of construction contract, including waiver of subrogation for completed work.
  • Settlement of multi-jurisdiction construction arbitration with subcontractor client responsible for less than 5% of settlement proceeds.
  • Obtained dismissal for an architectural engineering firm in a lawsuit involving professional liability and successfully mediated breach of contract counterclaims with attorney’s fees for a recovery of $400,000.
  • Represented a global telecommunications company in claim for damages to its cable infrastructure throughout Texas.
  • Obtained defense verdict in Parker County for a publicly-traded oilfield service company in a dispute with owner/operator of a Barnett Shale saltwater injection well seeking damages exceeding $7.7 million.
  • Obtained multimillion dollar settlement in Johnson County for oilfield manager injured during severe thunderstorm that resulted in arm amputation.
  • Obtained summary judgment for oil leaseholder against injured employee of drilling contractor based on Chapter 95 preclusion of liability of property owners for injuries to a contractor.
  • Active in monitoring the dismissal of claims related to his asbestos manufacturer clients.
  • Obtained summary judgment in Federal Court for lack of evidence of manufacturer’s assumption of liability and plaintiff’s failure to establish standing.
  • Obtained defense judgments in Dallas County for two defamation cases based on Texas Anti-SLAPP statutes and principles involving infringement of First Amendment constitutional rights to free speech, petition, and association. One judgment included attorneys’ fees and sanctions.
