The MDMKH transportation defense team represented a commercial motor carrier and driver in a case involving an alleged claim of serious bodily injury filed in Bexar County. The plaintiff’s alleged claims arose from an accident between the plaintiff’s vehicle and the defendants’ trailer. The defendants’ trailer became detached from a tractor and plaintiff then collided with the disabled trailer. Jennifer Cheek and Amy Lockhart developed evidence that the driver’s alleged negligence was not the cause of the subject accident since the detachment occurred approximately ten minutes before the accident. The court found that the detachment was too remote in time to have been a proximate cause of the accident and entered summary judgment dismissing all plaintiff’s claims on October 7, 2024.
