John Kenefick, Paul Downey, and James Mendez prevailed in a recent Dallas County trial on behalf of the firm’s developer client in a lawsuit brought by a large Homeowner’s Association (“HOA”) which alleged that the project had been improperly developed, designed and constructed. The HOA claimed that the negligence of the developer and the designers and contractors it hired resulted in the failure of over seven miles of retaining walls and screen walls. The HOA initially sought more than $25,000,000 in damages, not including attorney’s fees.
The trial team presented evidence to establish that the developer was not liable to the HOA for the claimed damages and the jury agreed, returning a “take nothing’ verdict for the Firm’s client.
